‘What more could he have done?’ – Novak Djokovic wins Australian visa appeal

An Australian judge has ordered that world number one Novak Djokovic be freed immediately and has quashed the cancellation of his visa. 

Djokovic has been kept in an Immigration Detention Hotel since being detained at the Australian border last week, with only his appeal standing between him and deportation.

However, his defence argued that he was mistreated by Border Force officials, who failed to give him adequate opportunity to resolve the queries they raised over the validity of the previous Covid-19 infection that was serving as his medical exemption from the vaccination requirement.

Those allegations from Djokovic has been upheld by an Australian court, with the judge ruling: “What more could this man have done?

“Here, a professor and an eminently qualified physician have produced and provided to the applicant a medical exemption.

“Further to that, that medical exemption and the basis on which it was given was separately given by a further independent expert specialist panel established by the Victorian state government and that document was in the hands of the delegate.”

Djokovic was then ordered to be released within 30 minutes of the order, which read:  “The respondent, by her servants or agents, including the Australian Border Force, take all steps and do all things as may be necessary to bring the applicant to premises as specified by the applicant’s solicitors on Monday, 10 January 2022 (and each day thereafter, including upon the delivery of judgment), to permit him to remain there until the conclusion of each hearing and to secure his safe return to detention upon the conclusion of each hearing.”

Assuming no further intervention from the Australian government, who have stated they reserve the executive personal power to still deport him, Djokovic is now free to defend the Australian Open title he won last year.
